Emulsen — Terms of Use

These terms are an agreement between you and the developer of Emulsen ("we", "us") covering your use of the Emulsen mobile application and the emulsen.com website. By installing or using the app, or by using the website (including joining the early-access list), you agree to them. If you do not agree, please do not use the app or the website.

How we handle information — for both the app and the website early-access signup — is described in the Privacy Policy.

1. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Emulsen on devices you own or control, for your own photographic use. This licence is subject to the rules of the app store you installed from.

You may not: resell, rent, or sublicense the app; reverse-engineer or decompile it except where that restriction is prohibited by law; remove branding or attribution; or use it to break the law.

2. Your content and your data

Everything you enter — cameras, rolls, frames, notes, photographs — is yours. We claim no ownership of it and, as described in the Privacy Policy, we never receive it. It lives on your device.

You are responsible for backing it up. Emulsen stores data locally and provides an export tool in Settings. If you lose your device, uninstall the app, or clear its storage, the data is gone and we cannot recover it, because we never had a copy. Export regularly if the data matters to you.

3. Emulsen Pro

Emulsen is free to use with limits: up to 3 cameras and 5 active rolls. Emulsen Pro removes those limits and unlocks Darkroom mode and Stats.

Pro is offered as:

• Lifetime — $49, a one-time purchase;
• Annual — $19.99 per year, an auto-renewing subscription;
• Monthly — $2.99 per month, an auto-renewing subscription.

Prices are in US dollars and may vary by region and over time. Prices shown in the app at the moment of purchase govern.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the period ending. You can manage or cancel a subscription in your Apple App Store or Google Play account settings — not in Emulsen, as we have no access to your billing.

Purchases are processed by Apple or Google. Refunds are handled by them under their policies, not by us. The "Lifetime" purchase means the lifetime of the Emulsen product, not a guarantee of any particular future feature.

Where in-app purchasing is not yet enabled, the app says so and no charge occurs.

4. Availability and changes

Emulsen is offered as-is and evolves over time. We may add, change, or remove features, and may stop distributing or supporting the app. We will not deliberately render your locally-stored data unreadable without offering an export path.

5. Third-party services and links

Emulsen can open external links — for example a retailer search for blank NFC stickers, a gallery URL you saved yourself, or your email client. We do not control those destinations and are not responsible for their content, products, or practices. Any purchase you make from a linked retailer is between you and that retailer.

Early-access list. The emulsen.com early-access form is provided by Google Forms. Submitting your email is optional; we use it only to send one launch notification, as described in the Privacy Policy. You can ask us to remove your address at any time by emailing info@emulsen.com.

6. Accuracy — please read this one

Emulsen provides photographic reference information, including camera details, film characteristics, exposure estimates from the light meter, and film development times drawn from manufacturer datasheets.

This information is provided for guidance and may be incomplete, outdated, or wrong. Exposure and development are affected by your equipment, chemistry, temperature, water, agitation, and technique. Emulsen cannot account for those.

You are responsible for verifying anything that matters to you against manufacturer documentation and your own testing. We are not liable for ruined film, mis-developed negatives, missed shots, or lost images. If a roll is irreplaceable, test first.

Photographic chemistry can be hazardous. Follow your chemicals' safety instructions and handle them at your own risk; Emulsen's timers and recipes are a convenience, not a safety system.

7. No warranty

To the fullest extent permitted by law, Emulsen is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of defects, or that its information is accurate.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost data, lost images, lost profits, or lost opportunity, arising from your use of Emulsen — even if advised such damages were possible.

Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid for Emulsen in the 12 months before the claim, or US $50.

Some jurisdictions do not allow certain exclusions, so parts of sections 7 and 8 may not apply to you. You may have rights under local consumer law that these terms do not override.

9. Termination

This licence ends if you stop using Emulsen or breach these terms. You may end it at any time by uninstalling the app. Sections 6, 7, 8, and 10 survive.

10. Governing law

These terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-laws rules.

Nothing in this section deprives you of the protection of mandatory consumer- protection laws of the country or state where you live. Where those laws give you rights that cannot be waived by agreement, they continue to apply.

11. Apple-specific terms

If you obtained Emulsen from the Apple App Store, you acknowledge that: these terms are between you and us, not Apple; Apple has no obligation to provide support for Emulsen; Apple is not responsible for any product warranty claim, product-liability claim, or third-party intellectual-property claim relating to Emulsen; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms. The "Last updated" date changes when we do. Material changes will be surfaced in the app or in the store release notes. Continuing to use Emulsen after a change means you accept it.
